Legal & Export Restrictions

Data Plus Incorporated (“Data Plus,” “we,” “us,” or “our”) provides payment processing services, Point of Sale (POS) systems, software solutions, and related business services in compliance with applicable United States laws and regulations.

1. Geographic Availability

Data Plus products and services are intended for use within the United States only, unless otherwise expressly approved by Data Plus in writing.

We do not offer services or ship equipment outside the United States without proper authorization and regulatory approval.

2. Compliance with U.S. Export Laws

Hardware, software, encryption technology, and technical data provided by Data Plus are subject to U.S. export control laws and regulations, including but not limited to:

  • The Export Administration Regulations (EAR) administered by the U.S. Department of Commerce

  • The International Traffic in Arms Regulations (ITAR) administered by the U.S. Department of State

  • Economic and trade sanctions enforced by the Office of Foreign Assets Control (OFAC)

By purchasing or using our products or services, you agree to comply with all applicable export and sanctions laws.

3. Prohibited Destinations

You may not directly or indirectly export, re-export, transfer, or make available any Data Plus products, software, or services to any country, region, or territory subject to U.S. trade embargoes or sanctions.

As of the effective date of this policy, restricted locations include, but are not limited to:

  • Cuba

  • Iran

  • North Korea

  • Syria

  • The Crimea, Donetsk, and Luhansk regions of Ukraine

This list may change based on U.S. government regulations, and compliance is required regardless of whether the list is updated here.

4. Prohibited End-Users and Uses

You represent and warrant that you:

  • Are not listed on any U.S. government restricted or prohibited party list, including the OFAC Specially Designated Nationals (SDN) List or the Entity List

  • Are not acting on behalf of, or providing access to, any restricted person or entity

  • Will not use Data Plus products or services for any unlawful or prohibited purpose, including activities related to nuclear, chemical, biological weapons, or missile technology

5. Encryption & Security Controls

Data Plus hardware and software utilize advanced encryption and security technologies to protect transaction data. These technologies are controlled for export purposes.

You may not:

  • Reverse engineer, decompile, or attempt to bypass security or encryption features

  • Modify or tamper with hardware or software in violation of applicable laws

Unauthorized diversion or misuse of these products is strictly prohibited.

6. Regulatory & Financial Institution Approval

All services provided by Data Plus are subject to approval by:

  • Acquiring banks

  • Payment networks (e.g., Visa, Mastercard)

  • Financial institutions and regulatory authorities

Service availability may vary based on business type, industry classification, geographic location, and regulatory requirements.

7. Customer Responsibility

Customers are solely responsible for ensuring that their use of Data Plus products and services complies with all applicable federal, state, local, and international laws, including export and sanctions regulations.

Any required export licenses or governmental authorizations are the responsibility of the customer. Data Plus is not responsible for equipment detained or seized due to non-compliance.

8. Right to Restrict or Terminate Services

Data Plus reserves the right to:

  • Restrict, suspend, or terminate services

  • Cancel orders or agreements

if we determine, in our sole discretion, that continued service may violate applicable laws, regulations, or compliance requirements.

9. Limitation of Liability

Data Plus shall not be liable for delays, service interruptions, or inability to perform resulting from:

  • Government actions or regulatory changes

  • Export denials or sanctions enforcement
